Terms and Conditions

Please Read through these very carefully, by paying a the 50% initiation fee – you are agreeing to all the below terms & conditions.

Payment

50% of quote is payable before commencing of website creation. Remainder is payable prior to the website being made live/published and or access codes handed over.

By paying the 50% initiation fee you are agreeing to all these listed terms & conditions

This 50% initiation fee is non-refundable.

Commencement of Work

Work will commence only when all content, imagery and the design brief are received and 50% (non-refundable) deposit is remitted.

Final invoice will be issued once the job has been signed off.

Supply of Materials

You must supply all materials and information required by us to complete the work in up front. Such materials may include, but are not limited to, photographs, written copy, logos and other printed material. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount.

Where you fail to supply materials, and that prevents the progress of the work, we have the right to invoice you for any part or parts of the work already completed.

Please check all text provided very carefully, as spelling and typographic corrections will be done at our hourly rate.

Additional Costs / Charges

Additional functionality, pages or changes to images will be billable. All content must be supplied (proofed and checked by yourselves) in a ready to use format. Changes to spelling or grammar may be billed.

If more work is added while the project is underway, then this will be quoted and invoiced separately (payable upon invoice)

After each set of changes, the client has 5 working days to check the site and reply with changes.
This is to schedule time effectively as we need to consider other clients’ deadlines too

If the project is paused for longer than 2 weeks or no feedback is received for this amount of time, we reserve the right to charge a minimum additional continuation fee of R1000 or 10% (whichever is greater) before work re-commences. This is to recoup administrative costs, file management, job re-acclimatisation, time rescheduling and lost wages due to deadline shifts.

Review Stages

We are pleased to offer you the opportunity to make revisions to the design. However, we have the right to limit the number of design proposals to a reasonable amount and may charge for additional designs if you make a change to the original design specification.

Our website development phase is flexible and allows certain variations to the original specification. However any major deviation from the specification will be charged at the rate of R390 per hour.

Each site designed by us will be allowed 2 stages of review:

First review straight after the website is completed
Second review on the changes made after the first review.
Changes requested after the second review will be billable.

You have 7 days to do a full first review on your site.
Please note that after 7 days with no feedback we will issue final invoice.

You have 7 days to do a second review ONLY on the changes made after the first review, after 7 days we will issue final invoice. (with or without feedback).

Project Delays & Client Liability

Any time frames or estimates that we give are contingent upon your full co-operation and complete and final content being supplied upfront. During development there is a certain amount of feedback required in order to progress to subsequent phases (see REVIEW STAGES above). It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.

In the unlikely event that a client’s website should experience technical difficulty, or downtime post handover (full payment or invoice) – the designer accepts no responsibility and shall not be held liable for any financial loss suffered by the client as a result.

The client is responsible for the regular maintenance & upkeep of their site.

Self Hosted Sites

Sites that are “self-hosted” by the clients (Not Hosted with SeeBee Design or Uniwebserve)
SeeBee is not be able to offer technical support to clients that have organised and or manage their own hosting packages.

 Approval Of Work

On completion of the work you will be notified and have the opportunity to review it. You must notify us in writing of any unsatisfactory points within 7 days of such notification. Any of the work which has not been reported in writing to us as unsatisfactory within the 7-day review period will be deemed to have been approved. Once approved, or deemed approved, work cannot subsequently be rejected and the contract will be deemed to have been completed and the 50% balance of the project price will become due.

Handover Of  A Project

Handover is complete once wp-admin access has been granted to the client AND/OR payment of full invoice has been made.

Rejected Work

If you reject any of our work within the 7-day review period, or not approve subsequent work performed by us to remedy any points recorded as being unsatisfactory, and we, acting reasonably, consider that you have been unreasonable in any rejection of the work, we can elect to treat this contract as at an end and take measures to recover payment for the completed work.

Abandonment of Project

If a client has not provided SeeBee Web Design with required approvals, feedback, or content for any 15 day period after a request has been initially made, SeeBee Web Design will consider the project abandoned. All incomplete work will remain the property ofSeeBee Web Design and any paid fees or deposits made are non-refundable.

Client’s wishing to restart an abandoned project will be subject to a 25% restart fee based on the total project estimate and the project work will commence subject to availability of SeeBee Web Design

Cancellation / Termination of a Project

Termination Fees: In the event of termination, Client shall pay be liable to pay a final 25% of the total invoice plus all Expenses, Fees, and Additional Costs incurred through the date of termination.

Screenshots for Advertising or Other Promotional 

I reserve the right to use for the purposes of advertising and promotions; screenshots or images of any site created by me indefinitely.

Third Party or Client Page Modifications 

All Clients are on handover given access to the administrative section of their site will. Please Note however, SeeBee Web design is not responsible for any damage created by the Client or agent of the Client and requested repairs will be assessed at an hourly rate of R420. [1 hour minimum charge].

Acceptance of the above Terms

By paying a deposit or the full invoice, the client signifies that they have seen and accepted the terms listed above.
